By using Printora, you confirm that you:

  • Have read, understood, and agree to be bound by these Terms of Service

If you do not agree to these terms, you must not use our service.

2. Definitions

In these Terms of Service:

  • "Service" or "Services" refers to our website, platform, AI tools, and custom printing services
  • "Product" or "Products" refers to physical items we print and deliver (phone cases, mugs, apparel, etc.)
  • "User Content" refers to images, designs, text, and other content you upload or create
  • "AI Tools" refers to our AI-powered image generation and design features
  • "Account" refers to your registered user account on Printora

3. Account Registration & Management

3.1 Eligibility

To create an account and use our Services, you must:

  • Be at least 16 years old
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our Services under applicable laws
  • Provide accurate and complete registration information

3.2 Account Creation

You can create an account by:

  • Email & Password: Providing a valid email and creating a secure password
  • Google Sign-In: Using your existing Google account (subject to Google's terms)

By creating an account, you explicitly agree to these Terms of Service by clicking the "Agree" or "Sign Up" button.

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for losses caused by unauthorized use of your account.

3.4 One Account Per Person

You may only create one account. Creating multiple accounts to abuse promotions, circumvent restrictions, or engage in fraudulent activity is prohibited and may result in account termination.

3.5 Account Information

You must:

  • Provide accurate, current, and complete information
  • Update your information promptly if it changes
  • Not impersonate another person or entity
  • Not use a false email address or provide misleading information

4. Our Services

4.1 What We Provide

Printora offers:

  • Custom Printing: Print your designs on phone cases, mugs, apparel, and other products
  • AI Image Generation: Create custom designs using text prompts (powered by Google Gemini/Vertex AI)
  • Design Tools: Edit, enhance, and customize images and designs
  • Order Management: Track orders, view history, and manage shipping addresses
  • E-commerce Platform: Browse products, make purchases, and process payments

4.2 Service Availability

We strive to keep our Services available 24/7, but we do not guarantee uninterrupted access. Services may be unavailable due to:

  • Scheduled maintenance (we'll provide notice when possible)
  • Technical issues or outages
  • Third-party service disruptions (payment processors, cloud providers)
  • Force majeure events (natural disasters, pandemics, wars, etc.)

We are not liable for service interruptions or downtime.

4.3 Beta Features

We may offer beta or experimental features marked as "Beta," "Alpha," or "Preview." These features:

  • May not work as expected or may change without notice
  • Are provided "as is" without warranties
  • May be discontinued at any time

Use beta features at your own risk.

4.4 Changes to Services

We reserve the right to:

  • Modify, suspend, or discontinue any feature or service
  • Change pricing (with notice for existing subscriptions)
  • Add or remove products from our catalog
  • Update or improve our platform and tools

We'll provide reasonable notice for material changes that affect paid services.

5. Orders & Payments

5.1 Placing Orders

When you place an order:

  • You make an offer to purchase the product(s)
  • We send an order confirmation email (this does NOT mean we've accepted your order)
  • We accept your order when we begin production or ship the product (you'll receive a shipping notification)

We reserve the right to refuse or cancel any order for any reason, including:

  • Content violating our Acceptable Use Policy (see Section 10)
  • Suspected fraud or abuse
  • Product unavailability
  • Pricing or technical errors
  • Legal restrictions

5.2 Pricing

  • All prices are in USD unless otherwise stated
  • Prices include product cost but may not include shipping, taxes, or duties
  • Prices are subject to change without notice (orders in progress honor the original price)
  • We are not responsible for currency conversion fees charged by your bank

5.3 Payment Methods

We accept:

  • Credit/debit cards (Visa, Mastercard, American Express, etc.)
  • Digital wallets (Apple Pay, Google Pay, etc.)
  • Other payment methods supported by Stripe

Payments are processed by Stripe (see our Privacy Policy for details). We never see or store your full card details.

5.4 Payment Authorization

By providing payment information, you:

  • Authorize us to charge the total amount (product + shipping + taxes)
  • Confirm you are authorized to use the payment method
  • Agree to pay all amounts in full

If payment fails, we may cancel your order or retry the charge.

5.5 Taxes & Duties

  • Sales Tax: We collect sales tax where required by law (amount shown at checkout)
  • Import Duties: For international orders, you are responsible for customs fees, import duties, and taxes imposed by your country
  • VAT: European customers may be charged VAT as required by law

We are not responsible for additional fees imposed by customs or tax authorities.

5.6 Promotional Codes & Discounts

  • Promo codes are subject to terms and conditions (expiration dates, usage limits, etc.)
  • Only one promo code per order unless otherwise stated
  • Discounts cannot be applied retroactively to completed orders
  • We reserve the right to cancel orders that abuse promo codes

6. Shipping & Delivery

6.1 Production Time

Custom products are made-to-order. Production typically takes:

  • 2-5 business days for most products
  • Longer during peak seasons (holidays, sales events)

Production time is in addition to shipping time.

6.2 Shipping Methods & Time

Shipping options and timeframes vary by location:

  • Standard Shipping: 5-10 business days (after production)
  • Express Shipping: 2-5 business days (where available)
  • International: 7-21 business days depending on country and customs processing

Shipping times are estimates, not guarantees.

6.3 Shipping Costs

  • Calculated at checkout based on destination and shipping method
  • May offer free shipping promotions from time to time

6.4 Shipping Address

You are responsible for:

  • Providing an accurate, complete shipping address
  • Including apartment/unit numbers if applicable
  • Being available to receive delivery

We are not responsible for packages lost or delayed due to incorrect addresses.

Address changes must be requested before production begins. Once shipped, we cannot redirect packages.

6.5 Tracking

You'll receive a tracking number via email when your order ships. If tracking shows "delivered" but you didn't receive the package:

  • Check with neighbors, building management, or household members
  • Verify the delivery address was correct
  • Contact the shipping carrier
  • If unresolved, contact us within 7 days of delivery date

6.6 International Shipping

For orders shipped outside the originating country:

  • Longer delivery times due to customs processing
  • You are responsible for import duties, customs fees, and taxes
  • Packages may be held by customs for inspection
  • We cannot control customs delays or seizures

7. Returns, Refunds & Cancellations

7.1 Custom Products Policy

Important: Because all products are custom-made to your specifications, they are generally non-refundable and non-returnable unless defective or damaged.

7.2 Defective or Damaged Products

We will replace or refund products that are:

  • Defective: Manufacturing defects, printing errors, quality issues
  • Damaged: Arrived damaged due to shipping
  • Wrong Item: We sent the wrong product

To request a refund/replacement:

  • Contact us at support@printora.ai within 14 days of delivery
  • Provide your order number and photos showing the defect/damage
  • We'll review and respond within 48 hours

7.3 What We Do NOT Refund

  • Change of mind: "I don't like it" or "I ordered the wrong size"
  • Color differences: Minor variations due to screen calibration or printing process
  • Design errors: Typos, poor image quality, or design issues in your uploaded content (you're responsible for reviewing before ordering)
  • Delivery delays: Customs delays, carrier issues, or estimated timeframes that weren't guaranteed
  • Buyer's remorse: After receiving the product in good condition

7.4 Order Cancellation

You can cancel an order before production begins (usually within 1-2 hours of placing the order).

  • Contact support@printora.ai immediately with your order number
  • If we haven't started production, we'll issue a full refund
  • If production has started, we cannot cancel or refund

7.5 Refund Processing

Approved refunds are processed within:

  • 5-10 business days back to your original payment method
  • Bank processing times may add 3-5 days

7.6 European Consumers (Right of Withdrawal)

Under EU law, you normally have a 14-day right of withdrawal for online purchases. However, custom-made goods are exempt (EU Consumer Rights Directive 2011/83/EU, Article 16(c)).

Because all Printora products are made-to-order based on your specifications, the right of withdrawal does not apply (except for defective products).

8. User Content & Intellectual Property

8.1 Your Content Ownership

You retain all ownership rights to the images, designs, text, and other content you upload or create using our Services.

8.2 License You Grant to Us

By uploading or creating content on Printora, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Store, reproduce, and process your content to fulfill your orders
  • Print your designs on products
  • Transmit content to our printing partners and shipping carriers
  • Display your content in your account and order history

This license is only for the purpose of providing our Services and ends when you delete the content or close your account (except for orders already placed).

8.3 Public Content

Important: By default, designs you create are public and visible to other users. You can manually change them to private in your account settings.

When your designs are public, you grant us an additional license to:

  • Display your designs publicly on our website/app (e.g., in galleries, featured designs, inspiration feeds)
  • Use designs as examples in marketing materials (with attribution to your username)
  • Allow other users to view and potentially purchase similar products
  • Share your designs on social media to promote the platform

Privacy Options:

  • You can mark any design as private at any time in your account settings
  • Private designs are only visible to you and not shared publicly
  • Even private designs are still used to fulfill your orders (printed on products you purchase)
  • Changing a design from public to private removes it from public galleries but does not affect orders already placed

8.4 Your Responsibilities

You represent and warrant that:

  • You own or have the right to use all content you upload
  • Your content does not infringe third-party intellectual property rights (copyrights, trademarks, patents)
  • You have obtained necessary permissions/licenses for any content you do't own
  • Your content complies with our Acceptable Use Policy (Section 10)

8.5 Prohibited Content

You may NOT upload content that:

  • Infringes copyrights: Celebrity photos, movie/TV screenshots, artwork you do't own rights to
  • Infringes trademarks: Brand logos, sports team logos, company trademarks (without authorization)
  • Is illegal: Obscene, defamatory, threatening, or violates laws
  • Violates rights: Privacy violations, unauthorized use of someone's likeness

8.6 Copyright Infringement Claims (DMCA)

If you believe content on Printora infringes your copyright, please send a DMCA notice to:

  • Your contact information (name, address, email, phone)
  • Description of the copyrighted work
  • URL or location of the infringing content on Printora

  • Statement that your notice is accurate and you're authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

8.7 Our Intellectual Property

All content on Printora (excluding user content) is owned by us or our licensors, including:

  • Website design, layout, and code
  • Printora logo, branding, and trademarks
  • Product mockups and templates
  • Text, images, and videos we create

You may not copy, modify, distribute, or create derivative works without our written permission.

9. AI Tools & Limitations

9.1 How AI Tools Work

Our AI image generation is powered by Google Gemini/Vertex AI. When you provide a text prompt:

  • The AI generates an image based on patterns learned from training data
  • Results are unpredictable and may vary
  • The AI does not "understand" context like a human

9.2 AI-Generated Content Ownership

Ownership of AI-generated images is complex and varies by jurisdiction. By using our AI tools:

  • You receive a non-exclusive license to use the generated images for personal or commercial purposes
  • We do not claim ownership of AI-generated content you create
  • However, we cannot guarantee you have exclusive rights (others may generate similar images)

9.3 AI Limitations & Disclaimers

⚠️ Important AI Disclaimers:

  • Accuracy: AI may generate inaccurate, nonsensical, or low-quality images
  • Bias: AI may reflect biases in training data
  • Copyright Risk: AI-generated content may unintentionally resemble copyrighted works. You are responsible for ensuring your use doesn't infringe third-party rights.
  • Inappropriate Content: Despite our content filters, AI may occasionally generate inappropriate content
  • No Guarantees: We don't guarantee AI results will meet your expectations or be suitable for your purpose

9.4 Your Responsibilities When Using AI

You agree to:

  • Review all AI-generated content before using it
  • Ensure content doesn't infringe copyrights, trademarks, or other rights
  • Not use AI to generate illegal, offensive, or prohibited content
  • Accept the risks and limitations of AI-generated content

9.5 Content Moderation

We use automated systems to detect prohibited content (see Section 10). If your content is flagged:

  • Your order may be rejected or held for manual review
  • You have the right to request human review of automated decisions
  • Repeated violations may result in account suspension

9.6 No AI Training on Your Content

We do NOT use your uploaded images or AI-generated designs to train our AI models (or third-party models) without your explicit opt-in consent. See our Privacy Policy for details.

10. Acceptable Use Policy

10.1 Prohibited Content

⚠️ Zero Tolerance Policy: Printora has a zero tolerance policy for illegal, discriminatory, hateful, or harmful content. We reserve the right to refuse to print any material that violates this policy, and we will immediately terminate accounts that create or attempt to order such content.

You may NOT upload, create, or order products containing:

  • Illegal Content:
    • Child sexual abuse material (CSAM) or content exploiting minors
    • Content promoting or facilitating illegal activities (drug trafficking, weapons sales, fraud, etc.)
    • Content that violates criminal law in Germany, the EU, or your jurisdiction
  • Hate Speech & Discrimination:
    • Content promoting violence, hatred, or discrimination based on race, ethnicity, national origin, religion, caste, sexual orientation, gender, gender identity, disability, or any protected class
    • Racist symbols, slurs, or imagery (including Nazi symbols, KKK imagery, etc.)
    • Sexist, homophobic, transphobic, or otherwise discriminatory content
    • Content denying or glorifying atrocities, genocide, or crimes against humanity
    • White supremacist, extremist, or terrorist propaganda
  • Violence & Harmful Content:
    • Graphic violence, torture, or excessive blood/gore
    • Content glorifying or promoting self-harm, suicide, or eating disorders
    • Threats of violence or harm to individuals or groups
    • Content promoting terrorism or violent extremism
  • Adult & Sexual Content:
    • Pornography or sexually explicit material
    • Non-consensual intimate imagery
    • Sexual content involving minors (real or depicted)
    • Nudity (artistic nudity may be allowed at our sole discretion)
  • Harassment & Bullying:
    • Content targeting, threatening, or harassing specific individuals
    • Doxxing (sharing private personal information without consent)
    • Cyberbullying or coordinated harassment campaigns
  • Intellectual Property Violations:
    • Copyrighted images, artwork, photographs (without permission)
    • Brand logos, trademarks, sports team logos (without authorization)
    • Celebrity photos, movie/TV content (fan art may be allowed if transformative and non-commercial)
    • Counterfeit or fake branded merchandise
  • Misinformation & Fraud:
    • Impersonating brands, organizations, or individuals
    • Fake credentials, certifications, or official documents
    • Medical misinformation that could cause harm
    • Phishing, fraudulent schemes, pyramid schemes
  • Other Prohibited Content:
    • Content promoting dangerous activities or self-harm
    • Spam or unsolicited commercial content
    • Content that violates export control or sanctions laws

Note: This list is not exhaustive. We reserve the right to refuse to print any content we deem inappropriate, harmful, offensive, or in violation of our values, at our sole discretion.

10.2 Prohibited Activities

You may NOT:

  • Use our Services for illegal purposes
  • Attempt to hack, disrupt, or circumvent security measures
  • Scrape, crawl, or collect data from our platform without permission
  • Create fake accounts or impersonate others
  • Abuse promotions, promo codes, or referral programs
  • Reverse engineer, decompile, or attempt to extract our source code
  • Resell or commercially exploit our Services without authorization
  • Use automated tools (bots) to interact with our platform without permission

10.3 Enforcement

If you violate this Acceptable Use Policy, we will take immediate action, which may include:

  • Immediate order rejection: We will refuse to print any prohibited content and cancel the order without refund
  • Content removal: Immediate deletion of prohibited content from our platform
  • Account suspension: Temporary or permanent suspension of your account
  • Account termination: Permanent ban from Printora, including all future use of our Services
  • Legal reporting: We are required by law to report certain illegal content (such as CSAM, terrorist content, serious threats) to law enforcement authorities, including:
    • German Federal Criminal Police Office (BKA)
    • European Union authorities (Europol, national police)
    • National Center for Missing & Exploited Children (NCMEC) in the US
    • Relevant authorities in your jurisdiction
  • Cooperation with authorities: Full cooperation with law enforcement investigations, including providing user information and evidence
  • Legal action: We reserve the right to pursue legal action to recover damages, costs, and attorney fees
  • Platform bans: Sharing information with other platforms to prevent abuse

⚠️ Legal Consequences: Creating, distributing, or attempting to order illegal content (especially CSAM, hate speech, or terrorist content) is a serious crime that can result in criminal prosecution, fines, and imprisonment under German, EU, and international law. We will cooperate fully with law enforcement to ensure violators are prosecuted to the fullest extent of the law.

10.4 Content Moderation

We use a combination of automated systems and human review to detect and prevent prohibited content:

  • AI-powered detection: Automated scanning for prohibited imagery, text, and patterns
  • Human review: Manual review of flagged content by our moderation team
  • Proactive monitoring: Regular audits of public designs and user reports
  • Pre-production review: All orders are subject to review before printing

If our systems flag your content incorrectly, you can request human review by contacting support@printora.ai.

10.5 Reporting Violations

See something that violates our policies? Please report it immediately.

To report prohibited content, email support@printora.ai with the subject line "Content Violation Report" and include:

  • Description of the violation (which policy it violates)
  • URL or location of the content (design ID, username, etc.)
  • Screenshots if applicable
  • Your contact information
  • Any additional context that would help our review

We review all reports within 24 hours and take action on valid violations immediately. For urgent reports involving illegal content or imminent harm, please also contact local law enforcement.

Your report will be kept confidential. We do not tolerate retaliation against users who report violations in good faith.

11. Disclaimers & Warranties

11.1 "AS IS" and "AS AVAILABLE"

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including:

  • Merchantability: That products will be suitable for your purpose
  • Fitness for a Particular Purpose: That products will meet your specific needs
  • Non-Infringement: That AI-generated content won't infringe third-party rights
  • Accuracy: That AI tools will produce accurate or error-free results
  • Availability: That Services will be uninterrupted or error-free

11.2 AI & Automated Systems Disclaimer

Regarding AI tools and automated systems:

  • AI-generated content may be inaccurate, biased, or inappropriate
  • We make no guarantees about quality, suitability, or originality of AI output
  • You assume all risks when using AI-generated content
  • Automated content moderation may have false positives or miss violations

11.3 Third-Party Services

We use third-party services (Stripe, Google Cloud, etc.). We are not responsible for:

  • Third-party service outages or failures
  • Payment processing errors
  • Shipping carrier delays or losses
  • Third-party terms, policies, or actions

11.4 No Professional Advice

Our Services do not constitute:

  • Legal advice (regarding copyright, trademark, or intellectual property)
  • Tax advice (you're responsible for tax obligations)
  • Business or financial advice

Consult appropriate professionals for advice.

11.5 Product Variations

Printed products may vary slightly from digital previews due to:

  • Screen calibration differences
  • Printing process limitations
  • Material variations (fabric texture, phone case material, etc.)

Minor color or quality variations are not defects.

12. Limitation of Liability

12.1 No Indirect Damages

To the fullest extent permitted by law, we are NOT liable for any indirect, incidental, consequential, special, or punitive damages, including:

  • Lost profits or revenue
  • Loss of data or business
  • Cost of substitute services
  • Emotional distress
  • Reputational harm

This applies even if we were advised of the possibility of such damages.

12.2 Total Liability Cap

Our total liability to you for any claims arising from these Terms or your use of our Services is limited to the amount you paid us in the 12 months before the claim arose, or $100 USD, whichever is greater.

12.3 Exceptions

These limitations do NOT apply to:

  • Liability for death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Liability that cannot be excluded by law (e.g., certain consumer protection laws)

12.4 Consumer Rights (European Union & Germany)

If you are a consumer in the EU or Germany:

  • Nothing in these Terms limits your statutory consumer rights under German law (BGB) or EU Directive 2011/83/EU
  • You have additional protections for defective products and unfair contract terms
  • Our liability limitations apply only to the extent permitted by mandatory consumer protection law

13. Indemnification

You agree to indemnify, defend, and hold harmless Printora, its owners, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of laws or third-party rights
  • Your User Content (copyright infringement, trademark violations, defamation, etc.)
  • Your use of AI-generated content that infringes third-party rights
  • Your use of our Services in a negligent or unlawful manner

Example: If a company sues us because you used their trademarked logo without permission, you're responsible for the legal costs and damages.

This indemnification survives termination of these Terms.

14. Termination

14.1 Your Right to Terminate

You may close your account at any time by:

  • Contacting support@printora.ai
  • Using the "Delete Account" feature in account settings (if available)

Upon account deletion:

  • Your access to Services will end
  • We'll delete your personal data as described in our Privacy Policy
  • We'll retain order/transaction records as required by law (10 years for tax purposes)

14.2 Our Right to Terminate

We may suspend or terminate your account, with or without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is used for fraudulent or illegal activity
  • We're required to do so by law or court order
  • Your account has been inactive for an extended period
  • We discontinue the Services (we'll provide reasonable notice)

14.3 Effect of Termination

Upon termination:

  • Your right to use Services ends immediately
  • Outstanding orders may still be fulfilled (at our discretion)
  • Unpaid amounts become immediately due
  • Sections that survive termination remain in effect (indemnification, liability limitations, dispute resolution)

14.4 No Refunds Upon Termination

If we terminate your account for breach of these Terms, you are not entitled to a refund for any pre-paid services or pending orders.

15. Dispute Resolution & Governing Law

15.1 Informal Resolution

Before filing a lawsuit, please contact us at support@printora.ai to try to resolve the dispute informally. Most disputes can be resolved through communication.

15.2 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law principles.

15.3 Jurisdiction & Venue

Any legal action arising from these Terms must be brought in the courts located in Germany (specific venue to be determined by German law).

You and Printora consent to the exclusive jurisdiction of these courts.

15.4 Consumer Rights (EU)

If you are a consumer in the EU:

  • You may also bring claims in the courts of your country of residence
  • Mandatory consumer protection laws of your country may apply
  • You can use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

15.5 No Class Actions

To the extent permitted by law, you agree to resolve disputes on an individual basis, not as part of a class action, collective action, or representative proceeding.
